  1. Why Liberal Neutrality Prohibits Same-Sex Marriage: Rawls, Political Liberalism, and the Family.Matthew B. O'Brien - 2012 - British Journal of American Legal Studies 1 (2):411-466.
John Rawls’s political liberalism and its ideal of public reason are tremendously influential in contemporary political philosophy and in constitutional law as well. Many, perhaps even most, liberals are Rawlsians of one stripe or another. This is problematic, because most liberals also support the redefinition of civil marriage to include same-sex unions, and as I show, Rawls’s political liberalism actually prohibits same- sex marriage. Recently in Perry v. Schwarzenegger, however, California’s northern federal district court reinterpreted the traditional rational basis review (...)

  2. Answerability without reasons.Lilian O'Brien - 2021 - In David Shoemaker (ed.), Oxford Studies in Agency and Responsibility. Oxford University Press. pp. 32-53.
It is widely accepted that we are answerable in a special way for our intentional actions. And it is also widely accepted that we are thus answerable because we perform intentional actions for reasons. The aim of this chapter is to argue against this ‘reasons’ view of such answerability. First, reasons are distinguished from practical standards. Then, it is argued that the best interpretation of the practices in which we treat agents as answerable is that they fundamentally concern practical standards (...)

  3. The Subjective Authority of Intention.Lilian O’Brien - 2019 - Philosophical Quarterly 69 (275):354-373.
While much has been written about the functional profile of intentions, and about their normative or rational status, comparatively little has been said about the subjective authority of intention. What is it about intending that explains the ‘hold’ that an intention has on an agent—a hold that is palpable from her first-person perspective? I argue that several prima facie appealing explanations are not promising. Instead, I maintain that the subjective authority of intention can be explained in terms of the inner (...)

  4. Hypocrisy in Politics.Maggie O’Brien & Alexandra Whelan - 2022 - Ergo: An Open Access Journal of Philosophy 9 (63):1692-1714.
The charge of hypocrisy is a peculiar kind of accusation: it is damning and ubiquitous; it is used to deny the hypocrite standing to speak; and it is levelled against a great variety of conduct. Much of the philosophical literature on hypocrisy is aimed at explaining why hypocrisy is wrongful and worthy of censure. We focus instead on the use of the accusation of hypocrisy and argue for a revisionary claim. People think that hypocrisy in politics is bad and that (...)

  5. On Our Moral Entanglements with Wild Animals.Gary David O’Brien - 2023 - Food Ethics 8 (15):1-8.
In Just Fodder, Milburn argues for a relational account of our duties to animals. Following Clare Palmer, he argues that, though all animals have negative rights that we have a duty not to violate, we only gain positive obligations towards animals in the contexts of our relationships with them, which can be personal or political. He argues that human beings have collective positive duties towards domesticated animals, in virtue of the kind of relationship between us established by domestication. However, when (...)

  6. Practical understanding.Lilian O'Brien - 2023 - Philosophical Issues 33 (1):183-197.
Well‐functioning agents ordinarily have an excellent epistemic relationship to their intentional actions. This phenomenon is often characterized as knowledge of what one is doing and labeled “practical knowledge”. But when we examine it carefully, it seems to require a particular kind of understanding ‐ understanding of the normative structure of one's action. Three lines of argument are offered to support this Necessity of Understanding thesis. The first appeals to the nature of intentional action and the second to our everyday reasons (...)

  7. Action explanation and its presuppositions.Lilian O’Brien - 2019 - Canadian Journal of Philosophy 49 (1):123-146.
In debates about rationalizing action explanation causalists assume that the psychological states that explain an intentional action have both causal and rational features. I scrutinize the presuppositions of those who seek and offer rationalizing action explanations. This scrutiny shows, I argue, that where rational features play an explanatory role in these contexts, causal features play only a presuppositional role. But causal features would have to play an explanatory role if rationalizing action explanation were a species of causal explanation. Consequently, we (...)

This chapter aims to get away from the ‘psychological attitude’ approach framing current philosophical discussion of delusion. We ask not what kind of attitude a delusion is – a belief or an imagination? Something else? – as if it were already clear what the ‘content’ of a delusion could be. We aim instead to shift attention to the question of the ‘object’ of delusions. What is delusion of? What is the object of this form of thinking? This focus on a (...)

This paper explores one aspect of God’s omniscience, that is, his knowledge of human minds. In §1 I spell out a traditional notion of divine knowledge, and in §2 I argue that our understanding of the thoughts of others is a distinct kind of knowledge from that involved in knowledge of the physical world; it involves empathizing with thinkers. In §3 I show how this is relevant to the question of how, and whether, God understands the thoughts of man. There (...)

In this paper, we raise and discuss a puzzle about the relationships among goods, reasons, and deontic status. Suppose you have it within your power to give someone something they would enjoy. The following claims seem platitudinous: you can use this power to reward whatever kind of option you want, thereby making that option better and generating a reason for that person to perform it; this reason is then weighed alongside and against the other reasons at play; and altogether, the (...)

    Rationalizing Inquiry and Historical Understanding.Lilian O’Brien - 2024 - Proceedings of the Aristotelian Society 124 (3):349-370.
In ‘The Epistemic Goals of the Humanities’, Stephen Grimm (2024) argues for epistemic continuities between the humanities, on one hand, and the social and natural sciences, on the other. This paper focuses on discontinuities. Drawing inspiration from Svetlana Alexievich’s literary non-fiction, I argue that if a reader is to gain a specific kind of understanding of the actions of the agents who appear in such work, they must engage in a rational evaluation of those agents’ reasons and actions. Prediction-based decisions, which are often made by utilizing the tools of machine learning, influence nearly all facets of modern life. Ethical concerns about this widespread practice have given rise to the field of fair machine learning and a number of fairness measures, mathematically precise definitions of fairness that purport to determine whether a given prediction-based decision system is fair. Following Reuben Binns (2017), we take ‘fairness’ in this context to be a placeholder for a variety of normative egalitarian considerations. We (...)

It has been widely accepted that intentional actions are “the actions to which “a certain sense of the question ‘why?’ is given application” (Anscombe 1957/2000: 9). But there are robust reasons for thinking that this claim is false. First, there are intentional actions for which such questions are unsound. We have good reasons for thinking that the questions are not “given application” in these cases. Second, when these questions are “given application” this is best explained, it is argued, not in (...)

There are various forms of teleological thinking central to debates in the early modern and modern periods, debates in which David Hume (1711–1776) is a key figure. In the first section, we shall introduce three levels at which teleological considerations have been incorporated into philosophical accounts of man and nature, and sketch Hume’s criticisms of these approaches. In the second section, we turn to Hume’s non-teleological ‘science of man’. In the third section, we show how Hume has an account of (...)

The behavior of macroeconomic indicators (reflecting the development of both the national economy as a whole and that of individual economic sectors) testifies to the low current efficiency of the functioning of economic entities in the context of economic activities. R&D collaborations between industry, government, civil society, and research ) have recently gained attention from R&D theorists and practitioners. In aiming to come to grips with their complexity, past models have generally taken a stakeholder-analytical approach based on stakeholder types. Yet stakeholder types are difficult to operationalise. We therefore argue that a processual model is more suited for studying the interaction in QHCs because it eschews matters of titles and identities. We develop such a model in which the QHC is (...)

Socioeconomic status refers to the family's social and economic standing in society. It is measured by combining an individual or group's economic and social position, which is often based on income, education, and occupation. It significantly affects academic performance and even one's health status. The pandemic changed the educational system, causing a huge transition from traditional learning methods to online learning. This shift resulted in confusion, burden, and difficulty among students from different walks of life. This study was conducted to (...)

  44. Rawls, Political Liberalism, and the Family: A Reply to Matthew B. O'Brien.Greg Walker - 2014 - British Journal of American Legal Studies 3 (1):37-70.
Responding to an article in a previous issue from Matthew B. O’Brien on the impermissibility of same-sex marriage, this reply corrects a misinterpretation of Rawls’s understanding of political liberalism and a misdirected complaint against the jurisprudence of the U.S. federal courts on civil marriage and other matters. In correcting these interpretations, I seek to demonstrate that a publicly reasonable case for same-sex civil marriage is conceivable in line with political liberalism. I conclude the article by arguing that, although the same-sex (...)

  46. Revisiting the Maxim-Law Dynamic in the Light of Kant’s Theory of Action.V. K. Radhakrishnan - 2019 - Kantian Journal 38 (2):45-72.
A stable classification of practical principles into mutually exclusive types is foundational to Kant’s moral theory. Yet, other than a few brief hints on the distinction between maxims and laws, he does not provide any elaborate discussion on the classification and the types of practical principles in his works. This has led Onora O’Neill and Lewis Beck to reinterpret Kant’s classification of practical principles in a way that would clarify the conceptual connection between maxims and laws. In this paper I (...)

  47. Hume’s Critique of Religion: Sick Men’s Dreams, by A. Bailey & D. O'Brien[REVIEW]Paul Russell - 2018 - Philosophical Quarterly 68 (273):867-70.
Hume’s Critique of Religion is a valuable and rewarding contribution to Hume scholarship. The atheistic interpretation that the authors defend is well supported and convincingly argued. Although Gaskin’s Hume’s Philosophy of Religion is (rightly) highly regarded, I believe that Bailey and O’Brien provide a more compelling and convincing interpretation. Their account is, in particular, much stronger in respect of the historical background and contextual considerations that they draw on to support of their interpretation. These historical advances are achieved without weakening (...)

  48. W.V.O. Quine,“From Stimulus to Science”. [REVIEW]Catherine Legg - 1996 - Metascience 5 (1):209-213.
"From Stimulus to Science" crystallises one of America's most celebrated philosophers' thinking of a lifetime on naturalised epistemology. This slim volume grew out of Quine's Ferrarer Mora Lectures of 1990 at the Universitat de Girona in Catalonia. Its overarching theme can fairly be described as rational reconstruction of the passage to mature, predictive scientific theory from “...the mere impacts of rays and particles on our surfaces and a few odds and ends such as the strain of walking uphill” (p. 16).

    W. V. O. Quine is the prominent advocate of naturalized epistemology, a collection of philosophical views that employ scientific methods, results, and practices to solve epistemological problems. In this paper, I explore whether Quine’s argument to replace epistemology by science is convincing. In naturalized epistemology, Quine totally rejects the normative aspect of epistemology; he focuses on the descriptive part of epistemology. Other thinkers such as Kim, Stroud, Almedir, Rorty argues that epistemology without norm is epistemology in name only. Furthermore, all (...)
